At Active Inland Empire we are aiming to dismantle financial barriers for people to participate in holistic health programs.

Disclaimer: Sessions may include intense loud sounds or silence which may cause discomfort for participants with auditory sensitivities. Outdoor sessions may have intermittent outside noises that mix in with the practice. 

For our breathwork experience you will be guided through a 60-minute exercise designed to be welcoming to beginners first starting this practice there are some instructor requests below.

Active Nights runs on our partner organizations and with contributors like you. We ask for a donation per RSVP to help keep the program active and running and provide those with struggling finances the ability to access programs like this.

Waitlist is a first come first serve basis. Active Inland Empire is willing to accommodate to serve the most amount of people possible (30 people) for the best experience for all participants. Please refer to our **Refund/ No-show policy** regarding how your donation reservation will be treated.

**Program Information:**

This beginner-friendly  breathing flow session is designed to be open and friendly for all levels.

This is a **60-minute** yoga flow class suitable for all levels. The focus is on creating a seamless connection between breath and movement, which helps build strength, flexibility, and balance. Each class can be different, with sequences often tailored to a particular theme or objective, making it a versatile and engaging practice.

With a carefully curated playlist, you'll flow seamlessly from one pose to the next, leaving you feeling refreshed, energized, and ready to take on the day. Start your journey towards a healthier, happier you.

Friendly reminders to help you prepare for your session:

* Arrive 5-10 minutes before class to sign in and set up.
* Notify the instructor of any injuries before class
* Bring your mat and props for use during class
* Wear comfortable clothing you can move in
* Avoid eating 1-2 hours before class if possible.
* Turn off cell phones
* Class begins and ends with a silent relaxation
* If you are late or need to leave early, be mindful and courteous of your fellow students.
* Be patient and work at your own pace. Breathe. Progress comes with practice.

WHEREAS, Active Inland Empire Inc, its parents, affiliates, and subsidiaries (collectively, "Active Inland Empire") is the owner and/or operator of a health and wellness nonprofit, that partners with health and wellness businesses for Active Nights (the "Program"). 
 
WHEREAS, the participation of the Program is equipped with a range of amenities and services including, but not limited to, weights and cardio equipment, exercise classes, pickleball courts, yoga, pilates, and more (collectively referred to as “Equipment” or “Activities”). 
 
WHEREAS, Active Inland Empire offers a variety of health and wellness Program, that includes but is not limited to behavioral health, Eastern and Western medicine modalities, and non-medical services such as nutrition counseling, light therapy, reiki and more (together, wellness and medical services are referred to herein as “Services”). 
 
WHEREAS, Active Inland Empire is willing to permit the individuals ("Invitees") signing this Agreement and participate in the Activities and Services, upon the terms and conditions of this Agreement. 
 
WHEREAS, the Activities and Services take place under Active Inland Empire’s watch located at the address listed for the activity ("Premises"). Furthermore, Active Inland Empire and Invitees may collectively be referred to herein as the "Parties." 
 
THEREFORE, for good and valuable consideration, including but not limited to being provided access to and use of the Premises and the stated Activities and/or Services, the undersigned, on behalf of themselves and any minor children named below, hereby agree as follows: 
 
Assumption of Risk.  
I understand and acknowledge that the Activities and Services that I want to participate in may be dangerous and may involve the risk that I will sustain serious injury, temporary or permanent disability, death, and/or property damage. I understand that Active Inland Empire may not provide supervision, instruction, or assistance for the use of the Equipment. I further acknowledge that any injury I may sustain while participating in Activities or Services may be compounded by negligent or delayed medical service or negligent or delayed assistance by Active Inland Empire. I VOLUNTARILY AND FREELY ASSUME ALL RISKS AND DANGERS THAT MAY OCCUR PURSUANT TO MY USE OF THE PREMISES AND PARTICIPATION IN ACTIVITIES OR USE OF SERVICES ON THE PREMISES, INCLUDING THE RISK OF INJURY, DEATH, OR PROPERTY DAMAGE, EVEN IF CAUSED BY THE NEGLIGENCE OF ACTIVE INLAND EMPIRE. 

Release and Waiver of Liability. 
I hereby agree, on behalf of myself, my heirs and my personal representatives, to fully and forever discharge and release Active Inland Empire and its affiliates, and their respective partners, agents, operators, managers, employees, and representatives ("Released Parties") from any and all claims I may have or hereinafter have for any injury, temporary or permanent disability, death, damages, liabilities, expenses and/or causes of action, now known or hereinafter known in any jurisdiction in the world, attributable or relating in any manner to my entry upon and use of the Premises and participation in the Activities and Services, whether caused by the negligence of Active Inland Empire and/or any of the Released Parties or by any other reason. I acknowledge and agree that this Release and Waiver of Liability for potentially dangerous Activities and Services is intended to be, and is, a complete release, as much as allowed by law, of any responsibility of the Released Parties for all personal injuries, temporary or permanent disability, death, and/or property damage sustained by me while on or using the Premises or participating in the Activities or Services.

Covenant Not to Sue.  
I agree, for myself and all my heirs, not to sue the Released Parties or initiate or assist in the prosecution of any claim for damages or cause of action against the Released Parties which I or my heirs may have as a result of any personal injury, death or property damage I may sustain while on or using the Premises or while participating in the Activities and/or Services. 

Indemnification.  
I hereby agree to defend, indemnify and hold harmless Active Inland Empire and the Released Parties from and against any third-party losses, damages, actions, suits, claims, judgments, settlements, awards, interest, penalties, expenses (including reasonable attorneys' fees) and costs of any kind for any personal injury, loss of life or damage to property sustained by reason of or arising out of my use of the Premises or participation in any Activities and/or Services on the Premises. 

Medical Treatment Release.  
I hereby authorize Active Inland Empire to secure, and I consent to, any medical treatment that may be given to me should Active Inland Empire determine, in its sole discretion, that I need medical care, as a result of my being on the Premises or from participating in the Activities and/or Services. I accept full responsibility for all costs related to my medical treatment, including any transport costs, and I release all parties involved from any type of liability for anything that may happen during my treatment or transport. 

Age Requirements. 
I understand that persons 15 years of age or older are permitted to be in the Club unsupervised. Persons ages 13 and 14 require the presence of an adult with them. Some classes may be available to children younger than 13 years old if accompanied by a parent, caregiver, or guardian. 
 
Communications. 
By signing below and providing my email address, I agree to receive marketing and promotional offers from Active Inland Empire or its affiliates, unless and until I indicate I no longer wish to receive such information. I understand that I can access the Club’s privacy policy on its website or App. 
 
Responsibility for Personal Property.  
I acknowledge and agree that I am fully and solely responsible for any of my property and personal belongings that I bring onto the Premises or that I use during the Activities and Services, and that Active Inland Empire will not be responsible for or provide any security for my property and personal belongings. 
 
Damage to Club or Premises. 
I agree to pay for any damage I may cause to the Club or Premises through my careless or negligent use or misuse thereof. 
 
Prohibited items and activities. 
I understand that the following items and activities are strictly prohibited:

Absolutely no alcohol, drugs, smoking or vaping is permitted in the Club or on the Premises. 
No weapons of any kind are permitted in the Club. 
Taking photos or filming others is not permitted without their prior knowledge and consent, and under no circumstances is any photography or filming allowed within the locker rooms, bathrooms, or quiet areas. 
Invitees may not conduct any kind of commercial or business activity in the Club and shall not receive compensation for acting as a personal trainer for anyone. 
Unless you have a registered service animal, no pets (including emotional support animals) will be permitted inside the Club. 
 
No Representations by Active Inland Empire.  
I acknowledge that Active Inland Empire makes no representation as to the condition of the Premises or the safety of the Activities and/or Services or any Equipment either on the Premises or used in the Activities. I accept and shall use the Premises, and its Equipment, in its "AS IS" condition. I acknowledge and agree that I am not relying upon any representation or statement by Active Inland Empire or its employees, agents, sponsors, or representatives regarding this Agreement or the Premises or Activities or Services, except to the extent such representations are expressly set forth in this Agreement. 
 
Governing Law and Venue.  
This Assumption of Risk, Release and Waiver of Liability, and Indemnification Agreement will be governed by and interpreted in accordance with the laws of the State of California, without giving effect to the principles of conflicts of law of such state. I agree that any action arising out of this Agreement must be brought exclusively in any state or federal court located in San Bernardino County, California. 
 
Waiver.  
No waiver of any term or right in this Assumption of Risk, Release and Waiver of Liability, and Indemnification Agreement shall be effective unless it is in writing and signed by an authorized representative of the waiving party. The failure of any party to enforce any provision of this Agreement shall not be construed as a waiver or modification of such provision, or impairment of its right to enforce such provision or any other provision of this Agreement thereafter. 
 
Survival.  
I understand that this Assumption of Risk, Release and Waiver of Liability, and Indemnification Agreement does not terminate and will be used for all future visits to Active Inland Empire’s Club and shall continue to be effective and enforceable. 
 
Compliance with Laws.  
In the performance of the terms of this Assumption of Risk, Release and Waiver of Liability and Indemnification Agreement and use of the Premises, the Parties shall comply with all applicable federal, state, and local laws, rules and regulations. 
 
Severability.  
If any provision or portion of this Assumption of Risk, Release and Waiver of Liability, and Indemnification Agreement shall be held by a court of competent jurisdiction to be illegal, invalid, or unenforceable, the remaining provisions or portions shall remain in full force and effect. 
 
Entire Agreement; Modification; Binding Effect.  
This Agreement is the entire agreement between the Parties with respect to the subject matter hereof and supersedes any prior agreement or communications between the Parties, whether written, oral, electronic, or otherwise. No change, modification, amendment, or addition of or to this Agreement shall be valid unless in writing and signed by authorized representatives of the Parties. This Agreement shall be binding upon and inure to the benefit of the successors, assigns, and legal representatives of the Parties. 
 
I HEREBY ACKNOWLEDGE THAT I HAVE FULLY READ AND UNDERSTAND EACH OF THE ABOVE PROVISIONS AND THAT I UNDERSTAND I AM GIVING UP SIGNIFICANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE Active Inland Empire. I ACKNOWLEDGE THAT I AM SIGNING THIS AGREEMENT FREELY AND VOLUNTARILY AND INTEND BY MY SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I AM AT LEAST EIGHTEEN (18) YEARS OF AGE AND FULLY COMPETENT TO EXECUTE THIS AGREEMENT.
