Participant Waiver, Release of Liability & Indemnification Agreement

Event Name: BLKAZRUN Black History Month 5K Run/Walk & Festival

By registering for and participating in the BLKAZRUN 5K Run/Walk & Wellness Festival (“Event”), I acknowledge, understand, and agree to the following:

ASSUMPTION OF RISK

I understand that participation in this Event includes, but is not limited to, a timed 5K run/walk, group fitness classes (including HIIT and yoga), wellness activities, vendor interactions, live entertainment, and being present in a crowded, outdoor festival environment.

I acknowledge that these activities involve inherent risks, including but not limited to physical injury, illness, muscle strains, sprains, fractures, falls, dehydration, heat-related illness, collisions with other participants, uneven surfaces, equipment failure, vendor-related incidents, acts of other participants, weather conditions, and other known or unknown risks that may result in serious injury or death.

I voluntarily and knowingly assume all risks, whether foreseeable or unforeseeable, associated with participation in the Event and presence at the Venue.

MEDICAL ACKNOWLEDGMENT

I certify that I am physically capable of participating in this Event and have not been advised by a medical professional to avoid physical activity. I understand it is my responsibility to monitor my physical condition and stop participation if I feel unsafe or unwell.

I authorize Event staff to obtain emergency medical assistance if necessary and agree that I am solely responsible for any medical expenses incurred.

RELEASE OF LIABILITY

In consideration for being permitted to participate, I hereby fully and forever release, waive, discharge, and covenant not to sue the following parties:

BLK Arizona Event Group LLC

Tanger Outlets, including the Venue owner, property manager, tenants, affiliates, officers, employees, agents, contractors, and representatives

All Event sponsors (including Propel Water), vendors, volunteers, instructors, staff, security personnel, and affiliated partners

(collectively referred to as the “Released Parties”)

from any and all claims, demands, damages, losses, liabilities, costs, or causes of action, whether known or unknown, arising out of or related to my participation in the Event or presence at the Venue, including claims arising from the negligence of the Released Parties, to the fullest extent permitted by law.

INDEMNIFICATION & HOLD HARMLESS

I agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, damages, losses, liabilities, costs, or expenses (including reasonable attorney’s fees) arising out of or related to:

My participation in the Event

My actions or omissions during the Event

Any injury, loss, or damage I cause to myself, other participants, vendors, or Venue property

VENUE & PROPERTY ACKNOWLEDGMENT

I acknowledge that the Event takes place on private property owned and/or managed by Tanger Outlets. I agree to comply with all Venue rules, posted signage, and instructions from Event staff or Venue representatives. I accept full responsibility for navigating the Venue safely, including uneven surfaces and shared public spaces.

PHOTOGRAPHY & MEDIA RELEASE

I grant BLKAZRUN and its partners unrestricted permission to capture and use my likeness, voice, and image in photographs, videos, and other media for promotional, marketing, and commercial purposes without compensation.

WEATHER, CANCELLATION & REFUNDS

I understand that the Event will take place rain or shine. I accept all risks related to weather conditions. I acknowledge that all registrations are non-refundable and non-transferable, regardless of personal circumstances or event conditions.

ACKNOWLEDGMENT OF AGREEMENT

I confirm that I have read and fully understand this Waiver, Release of Liability, and Indemnification Agreement. I understand that by accepting this waiver, I am giving up significant legal rights, including the right to sue the Released Parties.

I affirm that I am at least 18 years of age, or I am the parent/legal guardian of a minor participant and agree to these terms on their behalf.
