COMFORT ZONE RETREATS LIABILITY RELEASE AND WAIVER
By accepting the terms of this waiver, I hereby agree to the following:
I am participating in yoga classes, breathwork sessions, cold plunging, ice bath participation and all other activities offered by Comfort Zone Retreats or Eleanor Rome during the event of my own free will and at my own risk.

I understand that the activities I will participate in may be physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss, or death. I agree that neither I, my heirs, assigns, or legal representatives will sue or make any other claims of any kind against Comfort Zone Retreats, LLC, Eleanor Rome, or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.

I am in good health and have no physical limitations that would affect my participation in the retreat activities.  I understand that it is my responsibility to consult with a physician prior to and regarding my participation in these activities.

I agree to inform the instructor immediately if I feel any pain or discomfort during any activity.

I understand that the instructors may physically adjust me during yoga classes and breathwork sessions, and I give my consent for such physical adjustments and will let my instructors know if I do not want any physical adjustments.

I agree to stay within the designated areas during hiking, camping, and rafting activities, and to follow all instructions provided by the guides.
I understand that all activities are non-refundable and non-transferable.

I hereby release and hold harmless Comfort Zone Retreats LLC, its owners, instructors, employees, and agents from any and all liability, past, present, and future, resulting from or related to my participation in the retreat activities.
I acknowledge that I have carefully read this waiver and release and fully understand its contents. I am aware that this is a release of liability and I sign it of my own free will.

			
			

Somatic Breathwork Liability Waiver
 
I acknowledge that Somatic Breathwork is a deep and powerful process. I have notified the practitioners of any physical injuries, mental or psychological conditions I have. I engage in this experience willingly and take full responsibility for my own physical, mental, and emotional experiences during and after the session.
 
Contraindications
 
Somatic Breathwork is intended as a personal growth experience and should not be looked upon as a substitute for psychotherapy.  It is not appropriate for pregnant women, for persons with cardiovascular problems, including angina or heart attack, high blood pressure, glaucoma, retinal detachment, osteoporosis, history of seizures, stroke, major psychiatric conditions, recent surgery, acute infectious illness, or epilepsy. If you have any doubt about whether you should participate, please consult with your primary care physician. Persons with asthma should bring their inhaler and consult with their primary care physician.
 
Release
 
I hereby release and hold harmless Eleanor Rome & Comfort Zone Retreats, LLC from any and all results that arise during or from the Somatic Release Breath-work. I waive all rights under law regarding the same. I or my representative(s) agree to full release and hold Eleanor Rome & Comfort Zone Retreats, LLC harmless from and against any and all claims or liability of whatsoever kind or nature arising out of or in connection with my session(s).
 
Attestation of good health
 
I hereby confirm that I have read and understood the above information and attest that my general health is good to participate
					
						

						
1. AGREEMENT TO FOLLOW DIRECTIONS. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by Eleanor Rome and  , or the employees, representatives or agents of Eleanor Rome and  .						
2. ASSUMPTION OF THE RISKS AND RELEASE. I recognize that there are certain inherent risks associated with the above described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and further release and discharge Eleanor Rome and   for injury, loss or damage arising out of my or my family's use of or presence upon the facilities of Eleanor Rome and  , whether caused by the fault of myself, my family, Eleanor Rome and   or other third parties.						
3. INDEMNIFICATION. I agree to indemnify and defend Eleanor Rome and   against all claims, causes of action, damages, judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family's use of or presence upon the facilities of Eleanor Rome and  .						
4. FEES. I agree to pay for all damages to the facilities of Eleanor Rome and   caused by any negligent, reckless, or willful actions by me or my family.						
5. APPLICABLE LAW. Any legal or equitable claim that may arise from participation in the above shall be resolved under Texas law.						
6. NO DURESS. I agree and acknowledge that I am under no pressure or duress to sign this Agreement and that I have been given a reasonable opportunity to review it before signing. I further agree and acknowledge that I am free to have my own legal counsel review this Agreement if I so desire. I further agree and acknowledge that Eleanor Rome and Comfort Zone Retreats, LLC  has offered to refund any fees I have paid to use its facilities if I choose not to sign this Agreement.
						
7. ARM'S LENGTH AGREEMENT. This Agreement and each of its terms are the product of an arm's length negotiation between the Parties. In the event any ambiguity is found to exist in the interpretation of this Agreement, or any of its provisions, the Parties, and each of them, explicitly reject the application of any legal or equitable rule of interpretation which would lead to a construction either "for" or "against" a particular party based upon their status as the drafter of a specific term, language, or provision giving rise to such ambiguity.					
8. ENFORCEABILITY. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this Agreement or of any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not to be a part of this Agreement.						
9. DISPUTE RESOLUTION. The parties will attempt to resolve any dispute arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the parties will resolve the dispute using the below Alternative Dispute Resolution (ADR) procedure.						
Any controversies or disputes arising out of or relating to this Agreement will be submitted to mediation in accordance with any statutory rules of mediation. If mediation does not successfully resolve the dispute, then the parties may proceed to seek an alternative form of resolution in accordance with any other rights and remedies afforded to them by law.		
						
I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
