DISCOFIT COLLECTIVE LLC — EVENT PARTICIPATION WAIVER, RELEASE OF LIABILITY, TERMS & CONDITIONS, AND MEDIA CONSENT

PLEASE READ CAREFULLY — THIS IS A LEGAL AGREEMENT AND RELEASE OF LIABILITY

In consideration of being allowed to participate in any DiscoFit Collective LLC (“DiscoFit”) event, class, or activity (“Event”), I agree to comply with all rules, terms, and policies of DiscoFit.

I acknowledge that participation in physical fitness, wellness, and dance activities involves inherent risks, including but not limited to bodily injury, illness, disability, property damage, or death. Risks may arise from my own actions, inactions, negligence, or those of others, or from the condition of the venue, equipment, or environment. I voluntarily assume all such risks.

I certify that I am physically fit to participate, have not been advised otherwise by a qualified medical professional, and will stop activity immediately if I experience pain, dizziness, or discomfort. I acknowledge DiscoFit does not provide medical or emergency care.

I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby waive, release, and discharge DiscoFit Collective LLC, its owners, officers, employees, contractors, instructors, volunteers, partners, sponsors, vendors, and venues (“Releasees”) from any and all claims, liabilities, damages, or causes of action of any kind, including those arising from negligence, strict liability, or breach of duty, resulting from or related to my participation in the Event.

I agree to indemnify, defend, and hold harmless the Releasees from any and all claims, losses, damages, and expenses (including attorney’s fees) arising out of or related to my participation in the Event or my violation of these Terms.

I acknowledge the contagious nature of COVID-19 and other infectious diseases and voluntarily assume the risk of exposure or infection. I release the Releasees from all liability related to such exposure or illness.

I understand that events may be photographed or recorded. I grant DiscoFit Collective LLC, its affiliates, and assignees an irrevocable, worldwide, royalty-free right to use, reproduce, distribute, display, or create derivative works from my image, likeness, voice, or performance in any media for marketing, educational, or promotional purposes, in perpetuity, without compensation. I waive any right to inspect or approve materials.

I understand that DiscoFit reserves the right to remove any participant from the Event for any reason, including unsafe, inappropriate, or disruptive behavior, at its sole discretion.

I understand that events may be modified, postponed, or canceled due to weather, safety concerns, venue restrictions, government regulations, or circumstances beyond DiscoFit’s control. All ticket sales and fees are final and non-refundable.

By registering for or attending a DiscoFit Event, I consent to receive communications (email, SMS, or social media) related to upcoming events, promotions, and updates. My personal information will not be shared with third parties without consent.

If I am signing on behalf of a minor under 18, I certify that I am their parent or legal guardian and consent to the minor’s participation under all terms stated herein.

This Agreement shall be governed by the laws of the State of Florida. Any dispute arising under this Agreement shall be resolved through binding arbitration in Broward County, Florida, in accordance with the rules of the American Arbitration Association.

If any provision of this Agreement is held invalid, the remainder shall remain in full force and effect.

I HAVE READ AND UNDERSTAND THIS AGREEMENT. I AM AWARE THAT BY SIGNING THIS DOCUMENT, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I SIGN VOLUNTARILY AND UNDER MY OWN FREE WILL.
