## PARTICIPANT WAIVER, RELEASE OF LIABILITY & ASSUMPTION OF RISK

**PLEASE READ CAREFULLY BEFORE PARTICIPATING.**

By registering for, attending, checking in to, or participating in **Kickback Moves: HYROX Training**, presented by **The Wellness Kickback Inc.** in collaboration with its HYROX training partner **DRVEN**, I acknowledge and voluntarily agree to the following:

### 1. ACKNOWLEDGMENT OF PHYSICAL ACTIVITY

I understand that Kickback Moves: HYROX Training is a **high-intensity physical fitness experience** that may involve strenuous and physically demanding activities.

Activities may include, but are not limited to:

* Running, jogging, sprinting, and repeated running intervals
* Heavy and moderate weightlifting
* Squats, lunges, deadlifts, presses, carries, pulls, and other resistance exercises
* Sled pushes and sled pulls
* Farmer's carries and weighted carries
* Sandbags, kettlebells, dumbbells, barbells, weight plates, medicine balls, and other weighted equipment
* Wall balls
* Burpees and burpee broad jumps
* Rowing, SkiErg, and other cardiovascular equipment when available
* Jumping, crawling, pushing, pulling, bending, twisting, reaching, and rapid changes of direction
* Bodyweight exercises
* High-intensity interval and circuit training
* Repetitive movements performed while fatigued
* Partner, team, relay, or competitive exercises
* Outdoor and/or indoor training
* Other functional fitness and HYROX-inspired exercises

I understand that exercises, equipment, weights, distances, repetitions, and workout formats may vary.

### 2. ASSUMPTION OF RISK

I understand and acknowledge that participation in strenuous physical activity involves **inherent and other risks**, including risks that may not be foreseeable.

These risks may include, but are not limited to:

Muscle strains, sprains, soreness, bruising, cuts, falls, collisions, joint injuries, fractures, back or spinal injuries, equipment-related injuries, overexertion, dehydration, heat exhaustion, heat illness, dizziness, fainting, shortness of breath, abnormal blood pressure, cardiovascular complications, and other serious bodily injury.

I understand that heavy lifting and high-intensity exercise may place significant stress on the cardiovascular, respiratory, muscular, skeletal, and nervous systems.

I also understand that fatigue may affect coordination, balance, judgment, technique, and my ability to safely perform an exercise.

I **knowingly and voluntarily assume the inherent risks associated with participating** in this event.

### 3. PERSONAL HEALTH & FITNESS RESPONSIBILITY

I understand that it is my responsibility to determine whether I am physically capable of safely participating.

By participating, I represent that, to the best of my knowledge, I am physically able to participate in strenuous exercise.

If I have an injury, medical condition, physical limitation, recent surgery, pregnancy, cardiovascular concern, respiratory condition, or any other condition that could affect my ability to exercise safely, I understand that I should consult an appropriate healthcare professional before participating.

I understand that **The Wellness Kickback Inc., DRVEN, coaches, instructors, staff, volunteers, sponsors, and partners are not providing medical advice or medical clearance.**

### 4. RESPONSIBILITY TO MODIFY OR STOP

I understand that I am **never required to lift a particular amount of weight, maintain a particular running pace, complete a particular number of repetitions, or perform an exercise that I do not feel capable of performing safely.**

I am responsible for selecting appropriate weights and modifications based on my experience and physical abilities.

I agree to communicate with an instructor or coach if I need a modification.

I agree to immediately slow down, modify, or stop exercising if I experience pain, unusual shortness of breath, dizziness, weakness, nausea, chest discomfort, loss of balance, unusual fatigue, or any other concerning symptom.

I understand that competition, encouragement from others, or my desire to complete the workout does not relieve me of my responsibility to exercise within my abilities.

### 5. EQUIPMENT & TRAINING AREA

I understand that this event may involve the use of heavy weights and fitness equipment.

I agree to:

* Follow all instructions regarding equipment use.
* Use equipment only for its intended purpose.
* Maintain awareness of other participants while lifting, running, carrying, pushing, or pulling equipment.
* Avoid entering another participant's lifting or training area when unsafe.
* Immediately report damaged or unsafe equipment to event staff.
* Follow instructions regarding loading, unloading, carrying, and returning weights.
* Not intentionally engage in reckless or unsafe behavior.

I understand that training areas may contain weights, equipment, uneven surfaces, sweat, water, or other conditions that could create slipping, tripping, falling, or collision hazards.

### 6. RUNNING & OUTDOOR CONDITIONS

I understand that running portions of the event may take place indoors and/or outdoors and may involve pavement, grass, sidewalks, parking areas, tracks, or other surfaces.

I acknowledge potential risks associated with weather, heat, humidity, rain, wet surfaces, uneven terrain, obstacles, traffic, pedestrians, and other environmental conditions.

I agree to remain aware of my surroundings and follow the designated running route and instructions provided by event staff.

### 7. HYDRATION & HEAT SAFETY

I understand that high-intensity exercise, particularly in Florida heat and humidity or other warm conditions, can increase the risk of dehydration, overheating, heat exhaustion, and heat-related illness.

I am responsible for arriving appropriately hydrated, bringing or obtaining sufficient fluids, taking hydration breaks as necessary, and stopping activity if I experience symptoms of heat-related illness or overexertion.

### 8. INSTRUCTIONS & SAFETY RULES

I agree to follow reasonable safety instructions provided by coaches, instructors, venue staff, and event organizers.

I understand that event staff may ask me to modify an exercise, reduce weight, stop an activity, or discontinue participation if they reasonably believe continued participation may create a safety concern.

### 9. EMERGENCY MEDICAL CARE

If I become injured or experience a medical emergency during the event and I am unable to make decisions for myself, I authorize event personnel to contact emergency medical services and take reasonable steps to assist me until professional medical care becomes available.

I understand that **The Wellness Kickback Inc. and its partners do not guarantee that medical personnel will be present at the event.**

I understand that I am responsible for medical expenses incurred as a result of my participation to the extent permitted by applicable law and my insurance coverage.

### 10. VOLUNTARY PARTICIPATION

My participation is completely voluntary.

I understand the nature of this training experience and voluntarily choose to participate despite the physical demands and inherent risks associated with high-intensity exercise, running, lifting, and functional fitness training.

### 11. RELEASE & WAIVER OF LIABILITY

To the fullest extent permitted by applicable law, I voluntarily assume the inherent risks associated with my participation and agree to release, waive, and hold harmless:

**The Wellness Kickback Inc.; DRVEN; the event venue and property owner; event organizers; coaches; instructors; trainers; employees; contractors; volunteers; sponsors; vendors; partners; affiliates; officers; directors; agents; representatives; and their respective successors and assigns**

from claims for injury, loss, or damage arising from the inherent risks of my voluntary participation in the event, except for claims or liabilities that cannot legally be waived or released under applicable law.

Nothing in this waiver is intended to waive rights or claims that cannot legally be waived.

### 12. PERSONAL PROPERTY

I understand that I am responsible for my personal belongings before, during, and after the event.

The Wellness Kickback Inc., DRVEN, event organizers, venue, staff, and partners are not responsible for lost, stolen, or damaged personal property except where responsibility cannot legally be excluded.

### 13. PHOTO, VIDEO & MEDIA RELEASE

I understand that photography, video recording, and other media may be captured during Kickback Moves events.

I grant **The Wellness Kickback Inc.** permission to photograph, film, record, and use my image, likeness, voice, and appearance captured during the event for lawful promotional and organizational purposes, including social media, websites, advertisements, event recaps, promotional materials, sponsorship materials, grant materials, and other marketing communications, without compensation to me.

I understand that such content may be edited, reproduced, published, and distributed in digital or physical formats.

### 14. PARTICIPANT CONDUCT

I agree to conduct myself in a manner that reasonably protects my safety and the safety of other participants.

I understand that intentionally reckless behavior, failure to follow safety instructions, misuse of equipment, harassment, or conduct that places another participant at unreasonable risk may result in my removal from the event.

### 15. ACKNOWLEDGMENT & AGREEMENT

By completing registration, accepting this waiver electronically, checking in, and/or participating in Kickback Moves: HYROX Training, I acknowledge that:

I have carefully read and understand this waiver.

I understand that this event includes **strenuous exercise, extensive running, high-intensity conditioning, heavy lifting, and the use of weighted fitness equipment.**

I understand the risks associated with these activities.

I have had the opportunity to decide whether participation is appropriate for me.

I voluntarily choose to participate.

I voluntarily assume the inherent risks associated with my participation.

I understand that this agreement affects certain legal rights and that its provisions are intended to apply to the fullest extent permitted by applicable law.

**BY REGISTERING AND ACCEPTING THIS WAIVER, I CONFIRM THAT I HAVE READ, UNDERSTAND, AND VOLUNTARILY AGREE TO THE TERMS ABOVE.**
