ASSUMPTION OF RISK WAIVER AND RELEASE OF CLAIMS
For purposes of this document, “Assumption of Risk Waiver and Release of Claims” (hereinafter, “Waiver”), “Event” means any indoor or outdoor fitness session, group run/walk, social gathering, or other activity of any kind organized by, relating to, or involving Motion MIA LLC (d/b/a Motion Run Club MIA), New Culture Training Club (NCTC), and/or hosted at Smart Choice Garden Center LLC (d/b/a The Bamboo Grove), Broward County, Florida.
“Participant” means any individual competing, observing, cheering, running, walking, or otherwise participating in or present at an Event. “Parent/Guardian” means any parent or other guardian of a Participant under the age of 18.
In consideration of the opportunity to participate in the Event, I, the Participant or Parent/Guardian, acknowledge and agree that:

1. ASSUMPTION OF RISK
Participation in or attendance at the Event involves inherent risks and dangers of accidents, personal and bodily injury (including death and/or illness) and property loss or damage, and minor to severe economic or noneconomic losses. These may result from Participant’s own actions or inactions or negligence, as well as the actions or inactions or negligence of others.
There may be other risks not known to me and not reasonably foreseeable at this time. I understand and I have considered and evaluated the nature, scope and extent of the risks involved, and Participant or Parent/Guardian voluntarily chooses to assume all such risks, both known and unknown, even those risks that result from the negligence of the Released Parties (defined below) or others, and assume full responsibility for my participation in the Event.
I warrant that Participant is physically and mentally able to participate in the Event. I consent to treatment of Participant in the event of an emergency or other incident in which, in the reasonable judgment of the on-site personnel, Participant requires medical care. I further agree to pay all costs associated with such medical care and to indemnify and hold harmless the Released Parties (defined below) from any costs or claims arising from such medical care.

2. RELEASE FROM LIABILITY
I, for myself and on behalf of my heirs, estate, insurers, successors and assigns, fully and forever release and discharge Motion MIA LLC (Motion Run Club MIA), New Culture Training Club (NCTC), Smart Choice Garden Center LLC (The Bamboo Grove), and Broward County, their affiliates and subsidiaries, their respective officers, directors, shareholders, employees, agents, distributors, representatives, contractors, successors, assigns, and insurers, all Event sponsors, advertisers, volunteers, and staff, and all owners or lessors of premises used in connection with an Event (hereinafter, “Released Parties”), from any and all injuries (including death and/or illness), losses, damages, claims (including negligence claims), demands, lawsuits, expenses, and any other liability of any kind, of or to me, my property, or any other person, directly or indirectly arising out of or in connection with my participation in or attendance at the Event.

3. AGREEMENT NOT TO FILE SUIT OR OTHER CLAIMS
Participant or Parent/Guardian agrees not to sue or otherwise seek relief or damages from the Released Parties for any and all injuries (including death and/or illness), property loss or damage, and minor to severe economic or noneconomic losses, incurred directly or indirectly in connection with an Event.

4. AUTHORIZATION TO RECORD AND TO USE RECORDINGS AND NAME
I hereby grant to Motion MIA LLC (Motion Run Club MIA), New Culture Training Club (NCTC), and Smart Choice Garden Center LLC (The Bamboo Grove) permission to film, photograph, video record and otherwise record Participant’s or Parent/Guardian’s image, voice, avatar, name, biographical data, silhouette, body dimension, shape, posture, or any other aspect of the recording at the Event (collectively the “Recording”), and the right to use all or any portion of the Recording or the results thereof, in all media and in any manner now known or hereafter developed, in connection with the Event or otherwise without any additional consideration.
I represent that it is not necessary for Motion MIA LLC, NCTC, or Smart Choice Garden Center LLC to obtain permission from me other than as contained in this Waiver or to pay or otherwise compensate me or any third party in connection with the rights granted in this paragraph.

5. INDEMNITY
Participant or Parent/Guardian agrees to indemnify and hold harmless Motion MIA LLC (Motion Run Club MIA), New Culture Training Club (NCTC), Smart Choice Garden Center LLC (The Bamboo Grove), and Broward County, and their officers, directors, employees, or volunteers from any claims that may arise from or be related to Participant’s participation in any Event, including but not limited to all claims for compensation, medical care, or other damages, initiated by Participant or Parent/Guardian, or Participant’s or Parent/Guardian’s heirs, estate, insurers, successors and assigns.
The Released Parties shall have the right to recover reasonable expenses, costs, fees, and attorney and arbitration fees incurred to protect or enforce their rights under this Waiver, and any other damages allowed by law or equity.

6. NO ORAL MODIFICATION
I agree that the terms of this Waiver may not be changed or waived in any respect, except by a writing signed by me and an authorized officer of Motion MIA LLC, NCTC, or Smart Choice Garden Center LLC.

7. SEVERABILITY
In the event that any provision of this Waiver is determined to be invalid or unenforceable, the remaining terms and conditions shall be unaffected and shall remain in full force and effect.

8. ELECTRONIC ACKNOWLEDGEMENT
Participant or Parent/Guardian certifies that he or she has reviewed this Waiver, and that electronically acknowledging and/or attesting to accepting the terms of the Waiver is the legally binding equivalent of Participant’s or Parent/Guardian’s handwritten signature.
This Release and Waiver shall be construed and enforced in accordance with the laws of the State of Florida, and any provisions required to be included in a release and waiver of this type by any applicable and valid federal or State law, rule, or regulation shall be deemed to be incorporated herein.

By participating in the Event, I hereby release Motion MIA LLC (Motion Run Club MIA), New Culture Training Club (NCTC), Smart Choice Garden Center LLC (The Bamboo Grove), Broward County, all affiliates, volunteers, and any associated parties from any and all liability related to my participation.
I confirm that I am physically fit and do not have any medical conditions that would limit my ability to participate or put me at risk.
I understand that participating in this event is strictly voluntary and that there is an inherent risk of injury. I assume all risks associated with participation.
I also agree to be contacted by Motion MIA LLC (Motion Run Club MIA), New Culture Training Club (NCTC), and Smart Choice Garden Center LLC (The Bamboo Grove) in the future; my personal information will not be shared outside of this context, except to provide updates or opportunities related to promotions and partners.
By typing my full name below, I authorize Motion MIA LLC (Motion Run Club MIA), New Culture Training Club (NCTC), and Smart Choice Garden Center LLC (The Bamboo Grove) to collect and publish photos and/or videos of the Event for promotional and informational marketing purposes.
