Waiver of Liability, Assumption of Risk, and Release Agreement

I, [Participant’s Full Name], hereby acknowledge and agree to the terms of this Waiver of Liability (“Waiver”) in connection with my voluntary participation in any and all activities organized, sponsored, or affiliated with Newport Run Club (“Club”).

Assumption of Risk

I fully understand and acknowledge that engaging in running, jogging, training, races, workouts, social events, and related physical activities involves inherent and unpredictable risks, both known and unknown, including but not limited to: slips, falls, collisions, weather conditions, traffic hazards, dehydration, illness, injury, disability, property damage, or death.
I voluntarily choose to participate and assume all risks, even those that may arise from the negligence of the Released Parties (defined below).

Release and Waiver

In consideration of being permitted to participate in the Club’s activities, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby waive, release, and discharge Newport Run Club, its officers, directors, members, volunteers, sponsors, partners, agents, representatives, and any affiliated organizations (collectively, the “Released Parties”) from any and all claims, demands, causes of action, liabilities, or damages of any kind—whether arising in law or equity, and whether known or unknown—resulting from or in connection with my participation.

This release expressly includes, without limitation, claims of negligence, whether active or passive, but does not include claims arising from gross negligence or willful misconduct.

Indemnification

I further agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, costs, or expenses (including reasonable attorney’s fees) brought by third parties arising out of my actions, conduct, or participation in the Club’s activities.

Medical Treatment

In the event of an emergency, I authorize the Club and its representatives to secure medical treatment for me, if deemed necessary, and I agree to assume full financial responsibility for such treatment.

Physical Fitness

I certify that I am physically fit, in good health, and have no condition or impairment that would prevent my safe participation. I agree to immediately discontinue participation if I experience any health issues and to notify the Club in writing of any changes to my medical condition.

Media Release

I grant permission to the Club and its representatives to photograph, film, or record my participation, and to use such media for promotional, marketing, or educational purposes in any format, without compensation.

Governing Law and Venue

This Waiver shall be governed by and construed in accordance with the laws of the State of California. I agree that any dispute or claim arising under this Waiver shall be brought exclusively in the state or federal courts located in Orange County, California.

Severability and Entire Agreement

If any provision of this Waiver is held to be unenforceable, the remaining provisions shall remain in full force and effect. This document constitutes the entire agreement between me and the Club regarding liability, assumption of risk, and release, and supersedes any prior oral or written agreements.

By signing below, I acknowledge that I have carefully read this Waiver, fully understand its terms, and voluntarily agree to be bound by it. I am aware that I am giving up substantial legal rights, including the right to sue, and I sign this Waiver freely and voluntarily.
