PILATES IN THE CLUB – WAIVER & RELEASE OF LIABILITY
(Kingdom Nightclub Austin | March 20, 2026)

This Waiver and Release of Liability (“Agreement”) is entered into by the undersigned participant (“Participant”) in consideration of being permitted to attend and participate in Pilates in the Club (the “Event”) on March 20, 2026, hosted at Kingdom Nightclub, located at 505 E 7th St, Austin, TX 78701, United States. Doors open at 5:30 PM.

By purchasing a ticket, registering, or entering the premises, the Participant agrees to the following:

1. Assumption of Risk

I acknowledge that participating in Pilates, fitness classes, and related physical activities involves strenuous movement and inherent risks, including but not limited to muscle strains, sprains, fractures, fainting, dehydration, dizziness, abnormal blood pressure, heart conditions, or other injuries.

I voluntarily assume all risks associated with participation and acknowledge that Pilates in the Club, Kingdom Nightclub, instructors, DJs, vendors, sponsors, contractors, employees, volunteers, and affiliates are not responsible for any injury, illness, or medical condition that may occur.

2. Venue Environment & Event Conditions

I understand that this Event takes place in a nightclub environment that may include loud amplified music, flashing or strobe lights, lasers, fog or atmospheric effects, dim lighting, uneven flooring, and limited visibility.

I acknowledge that these conditions may increase the risk of disorientation, dizziness, or physical injury and voluntarily accept those risks.

3. Photography, Videography & Drone Notice

I understand that photography, videography, and drone footage may be captured during the Event.

I acknowledge that there is a small risk of accidental contact, distraction, or obstruction related to drones or handheld cameras and agree that Pilates in the Club, Kingdom Nightclub, media operators, vendors, and affiliates are not liable for any injury, inconvenience, or disruption related to filming.

I further understand that other attendees may independently record photos or videos, which the organizers cannot control.

4. Photography, Videography & Publicity Release

I grant full permission to Pilates in the Club, Kingdom Nightclub, and their affiliates, sponsors, vendors, and partners to photograph, film, and record my likeness, voice, and participation during the Event.

I authorize the unrestricted use of such media for promotional, marketing, commercial, or educational purposes in any medium without compensation.

I waive any right to inspect or approve final materials and release all claims related to their use.

5. Alcohol & Personal Responsibility

Alcohol may be available for purchase or service during the Event.

Only guests aged 21 years or older with valid government-issued identification may consume alcoholic beverages.

If I choose to consume alcohol, I accept full personal responsibility for my actions and any resulting consequences.

Pilates in the Club, Kingdom Nightclub, DJs, vendors, and affiliates are not responsible for any incident, injury, damage, or legal matter related to alcohol consumption.

6. Attendance, Punctuality & Refund Policy

I understand that doors open at 5:30 PM and that I must arrive early to allow sufficient time for parking and check-in.

Late arrival, missing a class, or failure to bring a required mat may result in forfeiture of my ticket and participation.

All ticket sales are final. There are no refunds, transfers, credits, or exchanges for any reason, including lateness, missed classes, illness, dissatisfaction, scheduling conflicts, or weather conditions.

7. Equipment & Sanitation

I acknowledge that I must bring my own exercise mat. Mats are not provided.

Shoes may not be permitted on the workout floor for sanitation and safety reasons.

While the venue is cleaned prior to the Event, I understand that a completely allergen-free or germ-free environment cannot be guaranteed.

8. Food, Beverage, Vendors & Services

Food, beverage, wellness, retail, and promotional vendors may be present.

I consume all food, beverages, supplements, products, or services at my own risk.

Pilates in the Club, Kingdom Nightclub, DJs, vendors, and affiliates are not responsible for allergic reactions, foodborne illness, injuries, or adverse effects related to vendor products or services.

9. Parking & Transportation

Parking may include street parking or nearby lots and is used at my own discretion and risk.

Pilates in the Club and Kingdom Nightclub are not responsible for theft, damage, towing, or vehicle-related incidents.

If I consume alcohol, I am solely responsible for arranging safe transportation.

10. Communicable Diseases

I acknowledge the risk of exposure to COVID-19 and other communicable diseases by attending a public event.

I release Pilates in the Club, Kingdom Nightclub, DJs, vendors, and affiliates from any claims related to illness, infection, or complications arising from attendance.

11. Release of Liability & Indemnification

I release, waive, and discharge Pilates in the Club, Kingdom Nightclub, instructors, DJs, vendors, sponsors, contractors, employees, volunteers, and affiliates from all claims, demands, or causes of action arising from my participation, whether caused by negligence or otherwise.

I agree to indemnify and hold harmless the above parties from any claims or damages resulting from my actions, conduct, or participation.

12. Acknowledgment of Understanding

I confirm that I have read and fully understand this Waiver and Release of Liability.

I understand that it is legally binding and intended to protect the organizers, venue, and partners to the fullest extent permitted by law.

By purchasing a ticket and attending the Event, I voluntarily agree to all terms, including full personal responsibility and the no-refund policy.
