WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

IMPORTANT: This agreement contains a waiver of your right to sue, a release of all claims, and a commitment to binding arbitration. PLEASE READ CAREFULLY BEFORE PARTICIPATING.

WAIVER
In consideration of being allowed to participate in the event described below, including associated activities, services, and use of premises, facilities, equipment, and transportation (collectively, the “Event”), I, for myself and on behalf of my heirs, representatives, executors, administrators, successors, assigns, and anyone acting on my behalf or estate, hereby:

- Release, waive, discharge, and covenant not to sue Pups N Chill, LLC, its owners, and shareholders (collectively, the “Protected Parties”) for any claims, damages, or liability, including but not limited to those arising from the negligence of the Protected Parties, related to my participation in the Event.

- This includes, without limitation, personal injury (including death), accidents, illnesses, and damage to or loss of personal property.

Protected Parties: Pups N Chill, LLC, its owners, and shareholders.

EVENT DESCRIPTION
Event Name: Pups N Chill
Activities: May include, but are not limited to, food and beverage service, cold plunges, ice baths, saunas, compression therapy, stretching, physical activity, interaction with shelter puppies, IV treatments, red light therapy, group congregation, and related activities.

ASSUMPTION OF RISKS
I acknowledge that participation in the Event is voluntary and involves inherent risks, which may vary and include, but are not limited to: Death, Paralysis, Heart attacks, Stroke, Drowning, Hypothermia/Hyperthermia, Exhaustion or heat stroke, Joint or bone injuries, Concussions, Scratches, bruises, sprains, Allergic reactions, foodborne illness, Minor/Severe burns, Exacerbation of pre-existing conditions, and exposure to COVID-19 or other communicable diseases.

By clicking the consent box or electronically signing this Agreement, I confirm I have considered these risks, consulted a healthcare provider as needed, and voluntarily choose to participate in the Event despite these risks.

INDEMNIFICATION
I agree to indemnify, defend, and hold harmless the Protected Parties from all claims, actions, suits, procedures, costs, expenses (including attorney’s fees), damages, and liabilities arising from my breach of this Agreement or participation in the Event. This indemnity includes claims by third parties due to my participation.

PUBLICITY RELEASE
I authorize the Protected Parties to use my name, image, and/or voice (collectively, “Likeness”) in any photograph, video, or sound recording made during the Event (collectively, “Materials”) for lawful purposes, including advertising and marketing. I waive any rights to inspect or approve the Materials or receive royalties or compensation.

CONTENT OWNERSHIP
By participating in the Event, I acknowledge that all content created, including photographs, videos, and audio recordings, is exclusively owned by Pups N Chill, LLC. This includes all rights to use, reproduce, modify, display, and distribute such content. Participants waive any claim to ownership or compensation for content created during the Event.

SEVERABILITY
If any part of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

GOVERNING LAW
This Agreement is governed by the laws of the State of Florida, without regard to its conflict of law provisions.

CONSENT TO ELECTRONIC SIGNATURE
I agree that clicking the consent box or electronically signing this Agreement has the same legal effect as a physical signature and confirms my intent to be bound by this Agreement.

ACKNOWLEDGMENT OF UNDERSTANDING
I have read this Agreement, fully understand its terms, and acknowledge that I am waiving substantial rights, including my right to sue the Protected Parties. I confirm that I am signing this Agreement freely and voluntarily, without any inducement.
