ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY, AND INDEMITY AGREEMENT
READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS
This Agreement is entered into between personal trainer LIANA GIANGIULIO (“Trainer”) and the undersigned ____________ (“Client.”)The provision of personal training services by Trainer to Client, and Client’s use of any premises, facilities or equipment are contingent upon this Agreement. The Client agrees for themselves and (if applicable) for the members of their family, to the following:
1. ASSUMPTION OF THE RISK. You (the Client) recognize that there are certain inherent risks associated with physical activity and personal training. You do so at your own risk and assume the risk of any and all physical injury and/or damage you may suffer, whether while engaging in physical exercise or not. This includes injury or damage sustained while and/or resulting from using any premises or facility, or using any equipment, whether provided to you by Trainer or otherwise, including injuries or damages arising out of the negligence of Trainer, whether active or passive, or any of Trainer’s affiliates, employees, agents (direct or ostensible), representatives, successors, and assigns. You also assume the risk to take the nutritional advice said by Trainer, as it is not a prescription and only acts as a suggestion.
Risk of injury includes (but is not limited to): injuries arising from use by Client or others of exercise equipment and machines, injuries arising from participation by Client or others in supervised or unsupervised activities or programs; injuries and medical disorders arising from exercising, including but not limited to heart attacks, strokes, heat stress, heat stroke, sprains, strains, tears, broken bones, fractures, torn muscles and ligaments, spinal cord injuries, pulled muscles, disabling injuries, and death, among others; and accidental injuries occurring anywhere within the facility where training services are being provided, as well as the dressing rooms, showers and restrooms. Trainer will not be held liable or responsible for injury sustained by the Client for the intervening actions of another individual and/or another event, including criminal acts, whether foreseeable or unforeseeable.
You (the Client) agree that you are voluntarily participating in the aforementioned activities and assume all risk of injury, illness, damage, or loss to your person and/or your property that might result, including, without limitation, any loss or theft of any personal property, whether arising out of the negligence of Trainer or the intervening act of another individual and/or event, including acts, whether foreseeable or unforeseeable.
2. RELEASE. You (the Client) agree on behalf of yourself (and all your personal representatives, heirs, executors, administrators, agents, and assigns) to release and discharge Trainer (and Trainer’s affiliates, related entities, employees, agents, representatives, successors, and assigns) from any and all claims or causes of action (known or unknown) arising out of the negligence of Trainer, whether active or passive, or any of Trainer’s affiliates, employees, agents, representatives, successors, and assigns. This waiver and release of liability includes, without limitation, injuries which may occur as a result of (a) your use of any exercise equipment or facilities which may malfunction or break, (b) improper maintenance of any exercise equipment, premises or facilities, (c) negligent instruction or supervision, including personal training, (d) negligent hiring or retention of employees, and/or (e) slipping or tripping and falling while on any portion of a premises where personal training is being conducted or while traveling to or from personal training.
I, ______________________________________, (Client) assume full responsibility for personal injuries to my person and, if applicable, to my my partner, legal beneficiaries and/or family members, and further release and discharge Trainer for any injuries, losses or damages aising out of my partner, legal beneficiaries or my family member’s use of or presence at any personal training service rendered by Trainer whether caused by the fault of myself, my family, my legal beneficiaries, my Trainer or a third party, whether foreseeable or unforeseeable. .
3. INDEMNIFICATION. I, _______________________________,(Client) agree to indemnify and hold harmless the Trainer against all claims, causes of action, loss, damages, liabilities judgments, costs or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my partner’s, legal beneficiaries or family member’s use of or presence at the premises where the personal training services are being provided by the Trainer.
4. FEES. I, _____________________________,(Client) agree to pay for all damages to the facilities and injuries of Trainer caused by any negligent, reckless, or willful actions by me, my partner, my legal beneficiaries or family members.
You (the Client) further expressly agree that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the State of New York and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full force and effect.
You (the Client) are aware and agree that by executing this waiver and release, you are giving up your right to bring a legal action or assert a claim against trainer for trainer’s negligence, or for any defective product used while receiving personal training from trainer. You have read and voluntarily signed the waiver and release and further agree that no oral representations, statements, or inducement apart from the foregoing written agreement have been made.
