Organizer: HOPR Pty Ltd (ABN 74646519440) (“HOPR”, “we”, “us”, “our”)

Participant: The registered individual (“you”, “your”, “Participant”)


1. AGREEMENT TO TERMS

By registering for, attending, or participating in the Event, you agree to the following Terms & Conditions and Waiver of Liability. If you do not agree, please do not participate.

These Terms are intended to ensure a safe, respectful, and positive experience for everyone involved.


2. DESCRIPTION OF EVENT & ACTIVITIES

Event Name: Re:Connect by HOPR Social Club

Event Activities:

Event activities include, without limitation, the serving and consumption of non-alcoholic beverages, cold plunges, ice baths, saunas, group movement and exercise classes (such as yoga, dance, and breathwork), stretching, sound and music sessions, congregation of people, and various other physical or wellness-related activities.

Participation in any activity is voluntary and at your own risk.


3. WAIVER OF LIABILITY

In return for being permitted to participate in the Event, including all associated activities and services offered at the Event, and the use of premises, facilities, staff, and equipment (collectively, the “Event”), you, for yourself and for your heirs, representatives, executors, administrators, successors, assigns, and any other person or entity acting on your behalf, do hereby release, waive, discharge, and promise not to sue the Released Parties (as defined below) for any claim, damages, or liability, including from the negligence of the Released Parties, in connection with your participation in the Event, including without limitation personal injury (including death), accidents or illnesses, and loss or damage to personal property.

This release includes any consequential, economic, or indirect losses (including, without limitation, loss of income or earning capacity) arising out of or in connection with participation in the Event.

The term “Released Parties” means HOPR Pty Ltd, its directors, employees, contractors, partners, sponsors, venue operators, service providers, and affiliates, as well as any individuals or entities involved in the organisation or execution of the Event.

4. ASSUMPTION OF RISKS

You acknowledge and agree that participation in the Event is completely voluntary, and that Event activities involve certain inherent risks which cannot be completely eliminated regardless of the care taken to avoid them. The participant acknowledges that there is an inherent risk of injury in physical activities such as dancing, movement, and exercise. It is the participant’s sole responsibility to ensure they are physically and medically fit to take part in the Event’s activities.

The specific risks vary from one activity to another and may include, without limitation:

• Death

• Paralysis

• Heart attacks

• Stroke

• Electrocution from the use of electrical equipment during the Event

• Drowning

• Hypothermia / Hyperthermia

• Frostbite

• Exhaustion or heat stroke

• Eye, joint, or bone injuries

• Concussions and loss of consciousness

• Scratches, bruises, sprains, and other injuries

• Risks associated with the consumption of food and beverages, including choking, foodborne illness, allergic reactions, or other adverse reactions

• Minor / severe burns

• Exacerbation of pre-existing conditions relating to any of the foregoing, including skin conditions

• Exposure to COVID-19 or any other bacteria, virus, or pathogen capable of causing a communicable disease or illness

By checking the consent box or electronically signing this Agreement, you represent, warrant, and declare that you have fully considered the risks associated with participating in the Event; that you do not have any health or medical condition or personal sensitivity that might be exacerbated by participation; that you have either consulted your medical provider about your participation and its associated risks or have knowingly decided not to do so; and that you are making an informed decision to participate in the Event despite the potential risks.

If you are pregnant, breastfeeding, or taking medication, you should seek medical advice before consuming HOPR products or participating in Event activities.

5. PERSONAL PROPERTY

You are solely responsible for your belongings. HOPR and the Released Parties are not liable for any loss, theft, or damage to personal property during the Event.

6. ALCOHOL, DRUGS, AND CONDUCT

To ensure a safe and inclusive environment for all attendees:

• No alcohol, illegal substances, or drugs may be brought into or consumed at the Event.

• HOPR reserves the right to refuse entry or remove any person under the influence, in possession of banned substances, or engaging in unsafe, disrespectful, or disruptive behaviour—without refund.

• Participants must follow the instructions of Event staff and facilitators at all times.

7. MEDICAL TREATMENT & EMERGENCIES

You consent to receive first aid or emergency medical treatment if deemed necessary during the Event and release HOPR and the Released Parties from any liability arising from such treatment or failure to provide further care.

8. PUBLICITY RELEASE

You hereby permit and authorise HOPR to use your name, image, and/or voice (collectively “Likeness”) in any photograph, image, video, or sound recording taken at the Event (“Materials”) for any advertising, marketing, or lawful purpose through any medium now known or hereafter created. You waive any right to inspect, edit, or approve such use and any right to royalties or compensation arising from their use.

9. INDEMNIFICATION AND HOLD HARMLESS

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, actions, suits, procedures, costs, expenses (including legal fees), damages, and liabilities that may arise out of your breach of this Agreement or participation in the Event, and to reimburse the Released Parties for any of the foregoing incurred in connection with your participation in the Event. This indemnity includes any claims, actions, or demands made against HOPR arising from your own negligent or reckless acts or omissions during the Event.

10. REPRESENTATION OF AGE

You hereby represent and warrant that you are at least 18 years of age at the time of agreeing to this Agreement. Individuals under 18 are strictly prohibited from participating in or attending the Event, regardless of parental or guardian presence. By agreeing to this waiver, you acknowledge that you meet this age requirement.

11. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to conflict of laws principles. Any dispute arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of New South Wales.

12. SEVERABILITY

This Agreement is intended to be as broad and inclusive as permitted by law, and if any portion is held invalid, the remaining portions shall continue to have full legal force and effect.

13. CONSENT TO ELECTRONIC SIGNATURE

You agree that checking the consent box or electronically signing this Agreement will have the same effect as a handwritten signature and constitutes your intent to be legally bound by its terms.

14. ACKNOWLEDGMENT OF UNDERSTANDING

I acknowledge and agree to the following:

I have carefully read this entire Agreement and fully understand its terms.

I understand that I am giving up substantial legal rights, including my right to sue the Released Parties for negligence.

I understand that participation in the Event carries inherent risks, including serious injury or death, as described above.

I have had the opportunity to consult with legal counsel or a medical professional if I chose to do so.

I am participating voluntarily and accept full responsibility for my involvement.

I intend this Agreement to be a complete and unconditional release of all liability to the greatest extent permitted by law.
