Event Waiver, Disclaimer, Release of Liability, Assumption of Risk & Agreement
THIS WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT (THE “AGREEMENT”) CONTAINS A WAIVER OF YOUR RIGHT TO SUE, A RELEASE OF ALL CLAIMS, AS WELL AS OTHER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS. PLEASE READ ALL OF THE PROVISIONS OF THIS AGREEMENT VERY CAREFULLY.

1. Definitions
Organizer means Namaste Life LLC, including its owners, officers, directors, employees, contractors, vendors, sponsors, partners, staff, volunteers, insurers, and affiliates.
Participant means any individual who purchases, registers for, accepts, presents, or uses an entry ticket, wristband, or credential to attend the Event, whether purchased, complimentary, or transferred, and includes any individual who enters or remains within designated Event areas of the Premises during the Event date, whether or not such individual has completed registration or waiver requirements. Unauthorized individuals who access Event areas without proper credential shall nevertheless be deemed Participants and assume all risks associated with entry.
Premises or Venue means the property, grounds, and all facilities made available for the Event, including but not limited to: event spaces, restaurants, cafés, bars, pools, spas, beaches, ocean waters, sidewalks, parking areas/garages, shared lots, wellness facilities, watersports facilities, common areas, and any other areas owned, operated, leased, partnered with, or controlled by the host property.

2. Full Release of Liability
In consideration for being permitted to participate in, attend, or be present at any Event hosted by the Organizer (“Event”), I, for myself and my heirs, representatives, executors, administrators, successors, and assigns, hereby fully and forever:
Release, waive, discharge, and promise not to sue the Organizer, the Premises or Venue, and their respective owners, officers, directors, employees, contractors, vendors, sponsors, partners, staff, volunteers, advertisers, service providers, insurers, and affiliates (collectively, the “Released Parties”);
From any and all claims, demands, damages, injuries, actions, or liabilities of any kind, whether known or unknown, foreseen or unforeseen, including those arising from the negligence of the Released Parties;
Including but not limited to personal injury (including death), illness, property damage, theft, or loss;
Regardless of ticketing or registration status, and whether past, present, or future Events.
Unauthorized Entry: Any individual on the Premises during the Event date, with or without valid access credentials, shall be deemed to have accepted this Waiver by virtue of their presence.

3. Scope of Coverage
This release applies to all areas of the Premises and to all goods, services, and activations, whether paid, complimentary, or discounted, including but not limited to:
Food and beverage;
Items, services, and activations provided by the Released Parties;
Cabanas, hotel or lodging bookings, and parking;
Pools, spas/jacuzzis, cold plunges, saunas, steam rooms;
Spa and wellness treatments, massage, chiropractic, compression therapy, IV therapy, red light therapy;
Watersports, ocean activities (including swimming, snorkeling, paddleboarding, kayaking, surfing, boating, jet skiing);
Recreational and interactive installations (inflatable slides, obstacle courses, dunk tanks, slip ’n slides, rock climbing, lawn games);
Photography, videography, drones, audiovisual equipment, and social media content (including live streams, recordings, attendee-generated posts, tags, or shares
Any other amenity, activity, product, purchase, or service offered on the Premises.
Food and beverage services provided by the Venue, its restaurants, or third-party vendors are not operated, managed, or controlled by the Organizer. Consumption of any food, beverage, or alcoholic product is at the Participant’s sole risk. The Organizer makes no representation as to the safety, quality, or suitability of such products and shall not be liable for any injury, illness, intoxication, allergic reaction, or other adverse effect arising from their consumption.

4. Assumption of Risks
I acknowledge and agree that participation is voluntary and involves inherent risks, including but not limited to:
Physical injury, illness, scratches, bruises, sprains, concussions, seizures, paralysis, heart attack, stroke, or death;
 Drowning, hypothermia, hyperthermia, exhaustion, or heat stroke;
 Slips, trips, falls, or accidents with equipment or facilities;
 Allergic reactions, choking, foodborne illness, dehydration, poisoning, or other adverse reactions to food, beverages, supplements, or substances;
 Burns (minor to severe), sunburn, frostbite, or overexposure to elements;
 Electrocution or shock from equipment;
 Communicable diseases, viruses, bacteria, pathogens, or exposure to bodily fluids or biological matter;
 Exacerbation or triggering of any pre-existing medical, physical, or psychological condition, including but not limited to cardiovascular conditions, asthma, epilepsy, musculoskeletal issues, allergies, autoimmune conditions, mental health disorders, and skin conditions such as cancer or eczema;
 Consumption of alcohol, controlled substances, medications, supplements, or mind-altering products, whether consumed before or during the Event, and regardless of whether provided, sold, sampled, or made available by the Organizer, Premises, or vendors/sponsors (even if products were taken home from Event and then consumed;
 Actions, negligence, or misconduct of other attendees, registered guests, hotel or property guests, unrelated third parties, vendors, sponsors, contractors, staff, or volunteers.
I affirm I have considered these risks, consulted medical providers if necessary, and voluntarily assume full responsibility for all risks, known or unknown.

5. Indemnification & Conduct
I acknowledge and agree that the Released Parties are not responsible or liable for the actions, omissions, or misconduct of other Event attendees, guests of the Premises, unrelated third parties, vendors, sponsors, contractors, staff, or volunteers, including but not limited to harassment, assault, physical altercations, theft, exposure to bodily fluids, or other unlawful or inappropriate acts.
I further agree to indemnify, defend, hold harmless, and reimburse the Released Parties against any and all claims, suits, costs, expenses (including attorney and expert fees), damages, or liabilities arising out of:
my participation in the Event;
my breach of this Agreement;
my actions, negligence, or misconduct while on the Premises; or
harm, injury, or damages caused by me to myself, to others, or to property.

6. Age Restriction
I represent and warrant that I am at least 21 years of age. Persons under 21 are strictly prohibited from participating in or attending the Event. Any person under 21 in designated Event areas shall be deemed an unauthorized entrant and subject to immediate removal. All Participants are subject to ID verification at any time by the Organizer, Venue staff, security, or law enforcement and must comply promptly with any such request as a condition of entry or continued attendance.

7. Conduct, Sobriety & Physiological Safety (Final Master Version)
Participants acknowledge that they are solely responsible for their own health and wellbeing before, during, and after the Event. By choosing to attend, each Participant affirms that they are in suitable physical, mental, and emotional condition to safely participate in Event activities and surroundings.
Participants understand that any substances, medications, supplements, or products consumed or used before attending the Event—including but not limited to alcohol, caffeine, recreational substances, prescription or over-the-counter drugs, or herbal remedies—may affect their physical or mental state, and that participation under such influence is entirely at their own risk.
While the Venue, vendors, sponsors, or partners may independently sell, serve, distribute, or provide food, beverages, supplements, samples, or other consumable or take-home products, such offerings are not provided, sponsored, or endorsed by the Organizer. Any consumption or use of such products—whether before, during, or after the Event—is at the Participant’s sole risk.
Participants are expected to behave responsibly and respectfully at all times. The Organizer reserves the right to deny participation or remove any individual engaging in belligerent, disruptive, unsafe, or disrespectful behavior without refund or compensation.
Participants assume full responsibility for any injuries, illnesses, complications, impairments, allergic reactions, or adverse effects resulting from their own consumption, use, or conduct, whether or not such consumption or use is disclosed, and regardless of whether the products or substances were provided, sold, sampled, or made available by the Venue, vendors, sponsors, partners, or any other third party.

8. Medical Treatment
I understand I am solely responsible for my care in case of injury or illness. Any treatment rendered by the Released Parties or third parties is at my sole risk, and the Released Parties assume no duty or liability for such care. I agree to assume and promptly pay all costs of any medical treatment rendered to me, whether by emergency personnel, third-party providers, or others, and I release the Released Parties from any responsibility for such expenses.

9. Publicity Release
I hereby permit and authorize the Released Parties to:
 (a) use my name, image, likeness, and/or voice (collectively, “Likeness”) in any photograph, video, motion picture, audio, or other media taken of or during the Event (collectively, “Materials”);
 (b) edit, alter, reproduce, or otherwise modify my Likeness as contained in the Materials; and
 (c) use, publish, broadcast, distribute, sell, license, assign, or otherwise transfer such rights for any advertising, marketing, promotional, commercial, archival, or lawful purpose, in any medium now known or later developed, worldwide and in perpetuity.
I understand and agree that I shall not have the right to review, approve, or receive copies of the Materials or any modified versions. I waive any right of privacy or publicity associated with the use of the Materials, and I further waive any right to royalties, compensation, or other consideration arising from or related to such use.

10. Dispute Resolution
Any dispute, claim, or cause of action arising out of or related to this Agreement or the Event shall first be resolved through good faith discussions.
If unresolved within a reasonable time, the parties agree to submit the matter to non-binding mediation administered by a mutually agreed-upon mediator in the State of Florida.
The parties shall select a mediator within thirty (30) days of a written request for mediation and conduct the mediation within sixty (60) days thereafter, unless otherwise mutually agreed in writing.
If mediation does not resolve the dispute, it shall be submitted to binding arbitration administered by JAMS (or AAA if JAMS is unavailable), to take place in the State of Florida within six (6) months after the conclusion of mediation, unless otherwise agreed.
All proceedings shall be conducted on an individual basis, not as a class or representative action.
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Venue for all proceedings shall be exclusively in the State of Florida.

11. Severability
If any provision is held unlawful, void, or unenforceable, the remainder shall continue in full force and effect to the maximum extent permitted by law.

12. Acknowledgment & Consent
I acknowledge that I have carefully read this entire Agreement, fully understand its terms, and have had the opportunity to consult with legal counsel. I understand that I am giving up substantial rights, including my right—and the rights of my heirs, personal representatives, successors, and assigns—to sue the Released Parties.
I confirm that I am entering into this Agreement freely and voluntarily, that I am not relying on any statements or representations of the Released Parties not expressly contained herein, and that I intend this Agreement to be a complete and unconditional release of all liability to the greatest extent permitted by law.
Each Participant acknowledges and agrees that they are solely responsible for obtaining and maintaining any personal health, accident, or liability insurance deemed necessary to cover their own participation in the Event. The Organizer is not responsible for providing or verifying insurance coverage for Participants.
By signing, presenting, or using a ticket to enter the Event or Premises, I further confirm that:
My consent, electronic signature, digital acknowledgment, or electronic acceptance (including online checkbox, typing initials, or e-mail confirmation) carries the same legal effect as a handwritten signature;
I knowingly waive substantial legal rights, including the right to sue;
No person may attend, enter, or remain at the Event or on the Premises without being bound by this Waiver, regardless of how access was obtained; and
My heirs, executors, administrators, successors, and assigns are likewise bound by this Agreement.
