PARTICIPANT LIABILITY WAIVER, RELEASE OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT

In consideration of being permitted to participate in a group Pilates class organized by Rise Pilates Club and led by Olivia Santelli aboard a boat, along with any related boarding, disembarking, cruising, social, fitness, and waterfront activities (collectively, the “Activities”), I knowingly and voluntarily agree to the following:

# 1. Acknowledgment and Assumption of Risk

I understand that participating in Pilates and being aboard a boat involve inherent and potentially serious risks. These risks include, but are not limited to:

* Muscle strains, sprains, fractures, overexertion, loss of balance, and other physical injuries
* Slips, trips, and falls on wet, uneven, moving, or confined surfaces
* Sudden movement, rocking, wakes, turbulence, or changes in the boat’s speed or direction
* Falling overboard, drowning, or other water-related injury
* Collisions with the vessel, equipment, docks, other boats, or other participants
* Exposure to heat, sun, wind, rain, lightning, and changing weather conditions
* Dehydration, heat exhaustion, heat stroke, seasickness, or motion sickness
* Delayed access to emergency medical treatment while on the water
* Equipment failure, operator error, or the acts or omissions of other participants or third parties
* Transportation-related risks while boarding, traveling aboard, or disembarking from the boat
* Serious injury, illness, permanent disability, paralysis, or death

I understand that this list does not include every possible risk. I knowingly and voluntarily accept all known and unknown risks associated with the Activities, whether caused by natural conditions, my own actions, the actions of others, or the ordinary negligence of a Released Party.

# 2. Health and Fitness Representation

I represent that I am physically and medically able to participate safely in the Activities. I am not aware of any injury, illness, pregnancy-related restriction, medical condition, medication, or other circumstance that would make my participation unsafe.

I understand that it is my responsibility to consult a qualified healthcare professional before participating if I have concerns about my health or physical ability. I agree to stop participating immediately and notify Olivia Santelli or another event representative if I experience pain, dizziness, shortness of breath, nausea, weakness, or any other unusual symptom.

I understand that Olivia Santelli and Rise Pilates Club are not providing medical advice, diagnosis, or treatment.

# 3. Participant Responsibilities

I agree to:

* Follow all instructions provided by Olivia Santelli, Rise Pilates Club, the vessel captain, crew members, and event staff
* Use reasonable care while boarding, participating, moving around the vessel, and disembarking
* Remain within designated areas of the boat
* Use safety equipment, including a personal flotation device, whenever directed
* Avoid any movement, exercise, or activity that I believe exceeds my abilities
* Notify event staff of any dangerous condition or emergency
* Refrain from participating while impaired by alcohol, cannabis, illegal substances, or any medication that could affect my balance, judgment, or coordination
* Comply with all posted rules and applicable boating and safety laws

I understand that Olivia Santelli, Rise Pilates Club, the vessel captain, or event staff may restrict or end my participation if they reasonably believe my conduct or condition presents a danger to myself or others.

# 4. Release and Waiver of Claims

To the fullest extent permitted by Texas law, I release and agree not to sue Olivia Santelli, Rise Pilates Club, the vessel owner, vessel operator, captain, crew members, event hosts, venue providers, sponsors, contractors, volunteers, employees, instructors, agents, affiliates, successors, and assigns (collectively, the “Released Parties”) for any injury, illness, death, property damage, loss, expense, or other claim arising from or related to my participation in the Activities, including claims resulting from the ordinary negligence of a Released Party.

This release does not apply to conduct that cannot legally be released under Texas law, including gross negligence, reckless conduct, or intentional misconduct.

# 5. Indemnification

To the fullest extent permitted by law, I agree to indemnify and hold harmless the Released Parties from claims, damages, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising from my actions, misconduct, failure to follow instructions, or violation of this Agreement.

# 6. Emergency Medical Care

If I become injured or ill and cannot provide consent, I authorize Olivia Santelli, Rise Pilates Club, the vessel captain, crew members, or event staff to obtain reasonable emergency medical assistance for me.

I understand that the Released Parties are not obligated to provide medical care and that access to emergency services may be delayed while the vessel is on the water. I accept full financial responsibility for any medical transportation, evaluation, or treatment I receive.


# 7. Personal Property

I understand that Olivia Santelli, Rise Pilates Club, and the other Released Parties are not responsible for the loss, theft, or damage of personal property, including phones, bags, clothing, jewelry, Pilates equipment, or other items brought aboard the vessel.

# 8. Texas Law and Severability

The laws of the State of Texas will govern this Agreement. Any legal action relating to this Agreement or the Activities must be brought in a court of proper jurisdiction located in Travis County, Texas.

If any provision of this Agreement is found unenforceable, the remaining provisions will continue in full force to the greatest extent permitted by law.

#9. Acknowledgment and Voluntary Agreement

I confirm that I have carefully read and understand this Agreement. I understand that I am giving up substantial legal rights, including certain rights to bring a lawsuit against Olivia Santelli, Rise Pilates Club, and the other Released Parties.

I sign this Agreement knowingly, freely, and voluntarily. I have had the opportunity to ask questions and seek independent legal advice before signing.
