EVENT LIABILITY WAIVER & RELEASE
AGREEMENT
PLUNGEWORX LLC & RUN, ROAST & REFRESH LLC
Applicable to Events Held at PortSide Pickle – 740 Commendencia St, Pensacola, FL
32502
PLEASE READ CAREFULLY – THIS IS A LEGALLY BINDING DOCUMENT
By signing this agreement, I (“Participant”) acknowledge and agree to the following on behalf of
myself, my personal representatives, heirs, next of kin, and assigns.
1. Acknowledgment of Event and Activities
I understand that I am voluntarily participating in Run, Roast & Refresh, an off-site wellness
event organized and facilitated by PlungeWorx LLC and Run, Roast & Refresh LLC, held at
PortSide Pickle (“Event”).
I acknowledge that this Event may include physical, wellness, and recreational activities
(“Activities”), including but not limited to:
●
cold plunge therapy
●
hot plunge therapy
●
infrared or red-light exposure
●
stretching, mobility work, running or physical movement
●
guided breathwork
●
recreational pickleball or general on-site movement
●
wellness demonstrations
●
consumption of food or beverages (non-alcoholic or, if available, alcoholic at the venue)
2. Assumption of Risks (Including Cold- and
Heat-Exposure Risks)
I understand that participation in the Activities involves inherent and potentially serious risks,
including but not limited to:
●
slips, trips, and falls on wet, damp, or uneven surfaces
sudden changes in heart rate, blood pressure, or breathing
cold-induced shock, hypothermia, arrhythmias, cardiac arrest, fainting, dizziness, or loss
of consciousness
overheating, dehydration, or heat-related illness from hot plunges or saunas (if
applicable)
muscle, tendon, ligament, or joint injuries
allergic reactions, skin irritation, or illness from materials, products, or water used
drowning-related risks (even in shallow water) due to fainting or loss of consciousness
food-borne illness or adverse reactions from food or beverages provided
any risks arising from the actions, inactions, or negligence of other participants,
spectators, venue staff, or members of the public
risks specific to being in or near bodies of water, ice baths, equipment, or temporary
setups
I voluntarily assume all risks—known, unknown, foreseeable, and
unforeseeable—associated with the Event, including risks of injury, illness, disability, or
death.
3. Release and Waiver of Liability
In consideration of being permitted to participate, I hereby irrevocably release, waive, discharge,
and hold harmless:
PlungeWorx LLC, Run, Roast & Refresh LLC, PortSide Pickle, their owners, officers,
members, employees, contractors, volunteers, agents, insurers, landlords, equipment
suppliers, and all affiliated parties
(collectively, the “Released Parties”)
from any and all liability, including but not limited to claims for:
●
personal injury
●
illness or infection
●
●
●
property damage
economic loss
wrongful death
whether caused by negligence, premises conditions, equipment failure, or any other act
or omission of any Released Party.
This waiver applies to the fullest extent permitted by Florida law.
4. Indemnification
I agree to defend, indemnify, and hold harmless the Released Parties from all claims,
damages, liabilities, and expenses (including attorney’s fees) resulting from:
(a) my participation in the Event or Activities,
(b) my conduct at the Event, or
(c) my breach of this Agreement.
5. Medical Representation & Emergency Consent
I represent that:
●
I am in good physical and mental health;
●
I have no condition that would make participation unsafe for me or others;
●
I am not under the influence of alcohol, drugs, or medication that may impair judgment.
I understand that no medical supervision is provided. If a medical emergency occurs, I authorize
the Released Parties to obtain emergency medical care on my behalf. I understand I am solely
responsible for any resulting medical costs.
6. Third-Party Venue Conditions
I acknowledge that the Event takes place at PortSide Pickle, which is not owned or controlled
by PlungeWorx LLC or Run, Roast & Refresh LLC.
I agree that the Released Parties are not responsible for:
●
any conditions of the premises;
●
the acts or omissions of PortSide Pickle, its employees, or patrons;
●
any hazards on or around the property, indoors or outdoors.
I accept the premises “as is.
”
7. Alcohol Notice (If Alcohol Is Available at the Venue)
If alcohol is available for purchase from PortSide Pickle:
●
I agree not to consume alcohol before participating in wellness Activities.
●
I acknowledge increased risks associated with combining physical exertion, heat/cold
exposure, and alcohol.
●
I accept full responsibility for any injury or harm resulting from alcohol consumption.
8. Photography & Media Release (Optional but
RECOMMENDED)
I grant permission for PlungeWorx LLC and Run, Roast & Refresh LLC to use photos, videos, or
media of me taken during the Event for marketing or promotional purposes without
compensation.
If I do not consent, I will notify staff before participating.
9. Governing Law, Severability, and Agreement Scope
This Agreement is governed by Florida law.
If any portion is found invalid, the remainder shall continue in full force.
This document constitutes the entire agreement and supersedes all prior discussions or
representations.
No modification is valid unless in writing and signed by PlungeWorx LLC or Run, Roast &
Refresh LLC.
