LIABILITY RELEASE, ASSUMPTION OF RISK & PHOTO/VIDEO WAIVER

PLEASE READ CAREFULLY BEFORE SIGNING. THIS IS A LEGAL DOCUMENT.

This Liability Release, Assumption of Risk, and Photo/Video Waiver ("Agreement") is entered into by the undersigned participant ("Participant") in favor of Alexy Posner, Swiftie Liftie Club, and AP Brand Group, including all owners, officers, employees, contractors, volunteers, agents, successors, assigns, sponsors, and affiliates (collectively, the "Released Parties").

1. ASSUMPTION OF RISK
I understand and acknowledge that participation in fitness classes, workouts, and related activities—particularly outdoor and recurring group fitness events—may involve inherent risks, including but not limited to:
Physical exertion and strenuous activity; Slips, falls, collisions, or contact with other participants; 
Weather conditions (including heat, cold, rain, uneven surfaces, and outdoor hazards); Equipment-related injuries; Muscle strains, sprains, broken bones, illness, heart attack, or other serious injury;
I voluntarily choose to participate and assume full responsibility for all risks, known and unknown, associated with my participation.

2. RELEASE OF LIABILITY
In consideration of being permitted to participate in any Swiftie Liftie Club fitness classes or events, I hereby fully and forever release, waive, discharge, and covenant not to sue the Released Parties from any and all claims, demands, damages, losses, liabilities, costs, or expenses of any kind arising out of or related to my participation, including but not limited to:
Personal injury
Property damage
Illness or death
This release applies whether caused by negligence or otherwise, to the fullest extent permitted by law.

3. MEDICAL ACKNOWLEDGMENT
I represent and warrant that:
I am physically and mentally able to participate in fitness activities; I have no medical condition that would prevent safe participation, or I have consulted a medical professional prior to participation; I understand that I am responsible for monitoring my own physical condition and will stop participation if I experience pain, dizziness, shortness of breath, or discomfort; I acknowledge that the Released Parties are not responsible for providing medical care and I consent to emergency medical treatment if deemed necessary.

4. INDEMNIFICATION
I agree to indemnify and hold harmless the Released Parties from any claims, actions, damages, or costs (including attorneys’ fees) arising out of my participation in the events or my breach of this Agreement.

5. PHOTO & VIDEO RELEASE
I grant Alexy Posner, Swiftie Liftie Club, and AP Brand Group the irrevocable right and permission to photograph, record, film, and otherwise capture my likeness, image, voice, and participation during the fitness classes or related events.

I understand and agree that these photos and videos may be used for marketing, promotional, social media, website, advertising, and other commercial or non-commercial purposes, without compensation or additional approval.
I waive any right to inspect or approve the finished product and release the Released Parties from any claims related to the use of such media.

6. SEVERABILITY
If any portion of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to conflict of law principles.

8. ACKNOWLEDGMENT & SIGNATURE
I acknowledge that I have read and fully understand this Agreement, that I am voluntarily giving up substantial legal rights, and that I am signing this Agreement freely and voluntarily.
