EVENT WAIVER, PHOTO RELEASE + EMAIL CONSENT
WAIVER AND RELEASE OF LIABILITY

IN FAVOUR OF: City Shred Inc (“City Shred”).

IMPORTANT! BY SIGNING THIS AGREEMENT YOU ARE AGREEING TO ACCEPT RISKS AND TO GIVE UP CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. PLEASE READ THE AGREEMENT CAREFULLY AND DO NOT SIGN THIS AGREEMENT UNTIL YOU HAVE READ IT IN FULL AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS.  

I understand that participation in WEST COAST SHRED (the “Event”) is voluntary and each individual who wishes to participate in the Event (the “Participant”), or in the case of a Participant under the age of majority their parent/guardian, must agree to the terms and conditions set out in this Agreement. While the Event is open to Participants under the age of majority, a parent/guardian of a Participant under the age of majority must complete the registration for the Event and in doing so agrees to bind the Participant and themselves to the terms of this Agreement.

I further understand that this Agreement is a legally binding agreement made for the benefit of City Shred and their respective directors, officers, employees, volunteers, and insurers (collectively, the “Releasees”). This Agreement ensures to the benefit of the Releasees and binds the Participant, their parent/guardian in the case of a Participant under the age of majority, and their respective heirs, executors, administrators and representatives, successors and assigns and all those who might claim through them. 

ACKNOWLEDGEMENT OF RISK 

Participation in the Event involves inherent risks, dangers, and hazards (the “Risks”), including risk of illness, serious and/or permanent injury or death, and/or damage to or loss of personal property. Such Risks may result directly or indirectly from:

1. Contact with food or drinks that may contain or have been exposed to known and potentially unknown irritants and allergens and contamination;

2. High and low energy physical activity and personal and general injuries arising from physical activity (including sprains, strains, fatigue, concussion, overexertion, exhaustion, cardio-pulmonary strain);

3. Environmental hazards (including allergies, dehydration, insect encounters); 

4. Risk of falling, accident, or collision due to various hazards, including uneven and/or slippery surface and the acts of other participants;

5. Theft, vandalism, and loss or damage to personal property;

6. Equipment failure or malfunction, including safety equipment; 

7. Lack of immediate access to medical attention or services;

8. Communicable disease (including, but not limited to COVID-19); and

9. The acts or omissions, including negligent or intentional acts or omissions, of the Releasees or other participants or third parties.

City Shred is unable to list all possible risks related to the Participant’s participation in the Event. The Participant (and parent or guardian thereof) knowingly and freely accepts and fully assumes all responsibilities for all risks, known and unknown, even if arising from the negligence of the Releasees.

RELEASE, WAIVER, AND INDEMNITY PROVISIONS

In consideration of City Shred allowing the Participant to participate in the Event, the Participant on their own behalf if of the age of majority, or in the case of a Participant under the age of majority their parent/guardian on their own behalf and on behalf of the Participant, agrees to the following:

1. To completely RELEASE, DEFEND, INDEMNIFY, HOLD HARMLESS AND FOREVER DISCHARGE the Releasees to the fullest extent permitted by law from all liability, either in law or equity, from any and all actions, causes of action, claims and demands, for damages, loss or injury, costs, interest, disbursements, and subrogated and derivative claims, howsoever arising, which heretofore may have been or may hereafter be sustained by the Participant, including any not now known or anticipated but which may arise in the future and all effects and consequences thereof, in connection with or in any way relating to for all personal injury, death, property damage, illness (including COVID-19), economic loss, out-of-pocket expenses, or other loss resulting from or arising out of the Participant’s involvement or participation in the Event (including, but not limited, any such loss to third parties caused or contributed to by the acts of the Participant) due to any cause, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES, VICARIOUS LIABILITY, BREACH OF ANY DUTY IMPOSED BY LAW, BREACH OF CONTRACT OR MISTAKE OR ERROR OF JUDGMENT OF THE RELEASEES, OR OTHERWISE;

2. Not to make any claim or take any proceedings against any other person or corporation who might claim contribution or indemnity under the provisions of any statute, or at common law, from the Releasees. In the event that the Participant has made or makes any claim or takes any proceedings against any other person or entity in connection with the Event, and that other person or entity claims contribution or indemnity from the Releasee, the Participant agrees to indemnify and hold harmless the Releasees in respect of that claim, including, without limiting the generality of the foregoing, indemnification of the Releasees in respect of any claim advanced against the Releasees, any prejudgment and post judgment interest on the claim, any costs payable to the other person or entity, and indemnification of the Releasees for its own costs on a full indemnity basis.

3. To be LIABLE FOR AND TO HOLD HARMLESS AND INDEMNIFY the Releasees from and against all claims, actions, proceedings, claims, damages, costs, demands, and liabilities whatsoever of any nature or kind, including court costs and legal costs (“Claims”), arising out of the Participant’s participation in the Event regardless of whether such Claims are brought by or on behalf of the Participant or another person or entity, including injuries or damages to third parties;

REPRESENTATION OF FITNESS

The Participant warrants that they are physically, mentally, and emotionally capable of participating in all aspects of this Event and that there is no medical reason that would restrict the Participant’s ability to participate in this Event.

MEDICAL AUTHORIZATION

Should the Participant require medical attention while involved in the Event and be unable to provide consent on their own behalf, the Participant on their own behalf if of the age of majority, or in the case of a Participant under the age of majority their parent/guardian consents to City Shred and its employees securing such medical care as they in their sole discretion deem necessary for the Participant’s health and safety. The Participant on their own behalf if of the age of majority, or in the case of a Participant under the age of majority their parent/guardian, acknowledge and understand that the Participant (or their parent/guardian) shall be solely financially responsible for any such medical care. If warranted, the Participant may be transported to hospital or medical treatment centre and City Shred and its employees are authorized to approve the provision of appropriate first aid and medical treatment.

PUBLICITY WAIVER

The Participant on their own behalf if of the age of majority, or in the case of a Participant under the age of majority their parent/guardian on their own behalf and on behalf of the Participant, hereby confirm that City Shred has irrevocable consent for the following without compensation or further contact:

i. To photograph, and/or film, and/or record interviews with the Participant. The photographs, films and recorded interviews are hereafter collectively called the “Stories”;

ii. To distribute, now or at any time in the future, the Stories to any person, including the general public, and to magazines, newspapers, television stations, radio stations, and/or any other person or organization that customarily presents information or news to the general public (collectively, the “Media”) for their use (whether in whole or in part and in any language) in publicizing or publishing the Stories, and to publish the Stories (whether in whole or in part and in any language) on City Shred’s website, and/or in City Shred publications, and/or on any social networking sites;

iii. To publicize for promotional purposes, the Participant’s name, age, voice and likeness, to any person, including the general public and Media, and on City Shred’s website, and/or in City Shred’s publications, and/or on any social networking sites, now or at any time in the future; and
To be added to the City Shred email list for future communications and updates surrounding the Event, future events and other news and offers shared by City Shred.

iv Given the nature of the web, social networking sites and current technology, in providing this consent it is acknowledged that City Shred cannot control the use of the Stories after it/they has been published on the web or social networking sites, and that the web and social networking sites may have their own terms and conditions (which may change from time to time) regarding the content posted on such sites.

JURISDICTION

The Participant on their own behalf if of the age of majority, or in the case of a Participant under the age of majority their parent/guardian on their own behalf and on behalf of the Participant, understands and agrees that the provisions of this Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the Country of Canada. Any dispute in any way relating to or arising out of the Event or this Agreement shall be litigated, if at all, before the Superior Court of Justice of Ontario, Canada, to the exclusion of the courts of any other city, province, state, or country, and the parties hereto irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Ontario.

SEVERABILITY

If any provision of this Agreement is held by a Court to be unenforceable, then such provision will be modified to reflect City Shred’s and the undersigned’s intention. All remaining provisions of this Agreement shall remain in full force and effect as drafted. 

By submitting this Agreement for registration to the Event, the Participant on their own behalf if of the age of majority, or in the case of a Participant under the age of majority their parent/guardian on their own behalf and on behalf of the Participant, ACKNOWLEDGE THAT THEY HAVE READ, UNDERSTOOD AND THAT THEY AGREE to the terms of this Agreement, including the RELEASE, WAIVER and INDEMNITY PROVISIONS, and indicate their full, voluntary, and informed acknowledgement and acceptance of all of the terms of this Agreement.
