WAIVER & RELEASE OF LIABILITY:

Express assumption of risk: I, the undersigned, am aware that there are significant risks involved in all aspects of physical training. These risks include, but are not limited to: falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains, sprains, cuts and scrapes. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participation in any activity or class while at, or under direction of SoLa CrossFit.
 

ILLNESS RELEASE: 

I, the undersigned, am aware of the existence of the risk of my physical appearance to the venue and my participation in the activities at SoLa CrossFit that may cause illness such as, but not limited to Influenza, MRSA, or COVID-19 that may lead to serious illness or death. I am fully and personally responsible for my own safety and actions while and during my participation and I recognize that I may, in any case, be at risk of contracting illness such as, but not limited to Influenza, MRSA, or COVID-19. With full knowledge of the risks involved, I hereby release, waive, discharge SoLa CrossFit, its board, officers, independent contractors, affiliates, employees, representatives, successors, and assigns from any and all liabilities, claims, demands, actions, and causes of action whatsoever, directly or indirectly arising out of or related to any loss, damage, injury, or death, that may be sustained by me related to COVID-19 while participating in any activity while in, on, or around the premises or while using the facilities that may lead to unintentional exposure or harm due to COVID-19. I agree to indemnify, defend, and hold harmless SoLa CrossFit from and against any and all costs, expenses, damages, lawsuits, and/or liabilities or claims arising whether directly or indirectly from or related to any and all claims made by or against any of the released party due to injury, loss, or death from or related to COVID-19.
 

ACKNOWLEDGEMENTS: 

I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others.



RELEASE: 

In consideration of all the above mentioned risks and hazards and in consideration of the fact that I am willingly and voluntarily participating in the activities offered by SoLa CrossFit, I, the undersigned hereby release SoLa CrossFit, their principals, agents, employees, and volunteers from any and all liability, claims, demands, actions or rights of action, which are related to, arise out of, or are in any way connected with my participation in any activities offered by SoLa CrossFit, including those allegedly attributed to the negligent acts or omissions of the above mentioned parties. This agreement shall be binding upon me, my successors, representatives, heirs, executors, assigns, or transferees. If any portion of this agreement is held invalid, I agree that the remainder of the agreement shall remain in full legal force and effect.



If I am signing on behalf of a minor child, I also give full permission for any person connected with SoLa CrossFit to administer first aid deemed necessary, and in case of serious illness or injury, I give permission to call for medical and or surgical care for the child and to transport the child to a medical facility deemed necessary for the well being of the child.



MEDIA CONSENT & RELEASE:

I, the undersigned, hereby authorize SoLa CrossFit, and its partners, agents, representatives, assigns, successors in interest and licensees, to photograph, audiotape, and/or videotape me and grant the SoLa CrossFit and its partners the irrevocable right to use my photograph, audio recording, video recording, or any reproduction or

modification thereof (the “Photograph,” “Audio,” and/or “Video”), in any manner or medium throughout the world an unlimited number of times in perpetuity in advertising, social media, promotion, exhibition, or any other lawful purpose.



I understand that I will not receive any monetary compensation for the permissions I am granting herein. I hereby waive any right of inspection of approval of the uses to which SoLa CrossFit may put the Photograph, Audio, and/or Video. I acknowledge SoLa CrossFit  will rely on this permission and hereby release and discharge SoLa CrossFit from any and all claims and demands arising out of or in connection with the Photograph or the exercise of the permissions granted here, including any or all claims for libel, invasion

of privacy, or emotional distress.



If I am signing on behalf of a minor child, I also give full permission for any person connected with SoLa CrossFit  the irrevocable right to use the minor child's photograph, audio recording, video recording, or any reproduction or modification thereof (the “Photograph,” “Audio,” and/or “Video”), in any manner or medium throughout the world an unlimited number of times in perpetuity in advertising, social media, promotion, exhibition, or any other lawful purpose.



INDEMNIFICATION: 

The participant recognizes that there is risk involved in the types of activities offered by SoLa CrossFit. Therefore the participant accepts financial responsibility for any injury that the participant may cause either to him/herself or to any other participant due to his/her negligence. Should the above mentioned parties, or anyone acting on their behalf, be required to incur attorney’s fees and costs to enforce this agreement, I agree to reimburse them for such fees and costs. I further agree to indemnify and hold harmless SoLa CrossFit, their principals, agents, employees, and volunteers from liability for the injury or death of any person(s) and damage to property that may result from my negligent or intentional act or omission while participating in activities offered by SoLa CrossFit, at the main building or abroad. This includes but is not limited to parks, recreational areas, playgrounds, areas adjacent to main building, and/or any area selected for training by SoLa CrossFit.
 

I have read and understand the foregoing assumption of risk, release of liability and policies. I understand that by signing it obligates me to indemnify the parties named for any liability for injury or death of any person and damage to property caused by my negligent or intentional act or omission. I understand that by signing this form I am committing to follow all the policies put forth by SoLa CrossFit. I understand that by signing this form I am waiving valuable legal rights.
